TERMS & CONDITIONS

1. ABOUT LOCOMATE

Locomate provides indoor maps, routing, venue discovery, offers, saved places, parking assistance, social and friend features, and related services at supported venues. Features vary by device, venue, location, and app version, and may be added, changed, suspended, or removed.

2. ELIGIBILITY

You must be at least 13 and legally permitted to use Locomate. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms for you. Do not use the service where prohibited by law.

3. YOUR ACCOUNT

You must provide accurate information, keep control of the phone number associated with your account, and protect OTPs and authentication credentials. You are responsible for activity under your account unless caused by our breach. Tell us promptly if you believe your account has been accessed without permission.

4. PERMITTED USE

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Locomate for its intended purposes, subject to these Terms and app marketplace rules. You may not:

• Break the law, infringe rights, harass people, impersonate others, or misuse friend and location-sharing features.
• Interfere with security, probe systems, introduce malware, scrape content, automate access without permission, or attempt to obtain another user’s data.
• Reverse engineer, copy, modify, resell, sublicense, or commercially exploit Locomate except where applicable law expressly permits it.
• Submit unlawful, harmful, deceptive, or infringing content, or upload another person’s photo without permission.
• Use maps, routes, offers, QR codes, rewards, or payment features fraudulently.

5. NAVIGATION AND SAFETY

Indoor positioning and route information can be incomplete, delayed, or inaccurate because of venue changes, signal conditions, device sensors, map data, or other factors. Stay aware of signs, barriers, staff instructions, emergency notices, and your surroundings. Do not use Locomate where distraction creates risk. Locomate is not an emergency service, accessibility guarantee, or substitute for official evacuation instructions.

6. FRIENDS, CONTACTS, AND LOCATION SHARING

Contact matching and friend features are optional. Only share presence or location with people you trust, and stop sharing when it is no longer needed. Do not use Locomate to track, intimidate, or monitor another person without authorization. A match does not verify a person’s identity, safety, or intentions.

7. OFFERS, VENUES, AND THIRD PARTIES

Stores, venues, mapping providers, payment providers, and other third parties are responsible for their own goods, services, availability, opening hours, prices, offers, fulfilment, refunds, and terms. Offers may have limits, expiry dates, exclusions, or venue-specific conditions. A listing does not constitute our endorsement. Third-party links and services are governed by their own terms and privacy policies.

8. AI AVATARS AND USER CONTENT

You keep rights you hold in photos, feedback, and other content you submit. You grant us a limited licence to host, process, reproduce, and transmit that content as needed to provide and improve the feature you requested, operate the service, and meet legal obligations. AI-generated avatars may not be unique or perfectly accurate. You are responsible for having permission to upload source material and for how you use the output.

9. INTELLECTUAL PROPERTY

Locomate, its software, interface, brand, artwork, text, and non-user content are owned by or licensed to PARAMAX TECHNOLOGIES PRIVATE LIMITED and protected by applicable law. Except for the limited licence above, these Terms do not transfer any intellectual-property rights to you. Third-party maps, store marks, and content remain the property of their respective owners.

10. PRIVACY

Our Privacy Policy explains how we handle personal information. By using permission-based features, you direct us to process the information needed to provide them.

11. SUSPENSION, TERMINATION, AND DELETION

You may stop using Locomate at any time and request deletion through our account deletion page. We may restrict or terminate access if you materially breach these Terms, create safety or security risk, misuse the service, or if required by law. Where reasonable, we will provide notice and an opportunity to address the issue.

12. DISCLAIMERS

To the fullest extent permitted by law, Locomate is provided “as is” and “as available.” We do not promise uninterrupted operation, error-free maps, continuous venue support, successful contact matches, offer availability, or that every route is suitable for every user. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, PARAMAX TECHNOLOGIES PRIVATE LIMITED and its officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of data, profit, opportunity, or goodwill arising from Locomate. Our aggregate liability for claims relating to the service will not exceed the greater of the amount you paid us for Locomate in the 12 months before the claim or INR 1,000. These limits do not apply where liability cannot lawfully be limited, including liability for fraud or wilful misconduct.

14. INDEMNITY

To the extent permitted by law, you will indemnify PARAMAX TECHNOLOGIES PRIVATE LIMITED against third-party claims, losses, and reasonable costs arising from your unlawful misuse of Locomate, your infringement of another person’s rights, or content you submit. This does not apply to the extent a claim results from our own breach or negligence.

15. APP MARKETPLACES

Apple, Google, and other app marketplaces are not parties to these Terms and are not responsible for Locomate or its support. Your use is also subject to the marketplace’s applicable terms. The marketplace and its subsidiaries may enforce provisions intended for their benefit where applicable.

16. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of India. Subject to any mandatory consumer rights or jurisdiction that applies where you live, courts in Mumbai, Maharashtra will have exclusive jurisdiction. Before filing a claim, contact us and allow 30 days to try to resolve the dispute informally.

17. CHANGES

We may update these Terms to reflect service, legal, or operational changes. We will post the revised Terms and update the date above, with additional notice where required. Continued use after the effective date means you accept the updated Terms; if you do not agree, stop using Locomate and delete your account.

18. GENERAL

If a provision is unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, acquisition, or transfer of the service. These Terms, the Privacy Policy, and any feature-specific terms form the entire agreement about Locomate.
